User Terms and Conditions for Omandoob Platform

These terms and conditions constitute an official agreement ("contract") between Omandoob Platform and the users of Omandoob Platform. Omandoob is an electronic platform that allows couriers to provide purchasing services on behalf of customers and deliver to their homes or other predetermined locations. The platform gives the customer the opportunity to select the appropriate courier to perform the delivery.

Any use of the services provided by Omandoob constitutes your acceptance of this contract and its terms. Therefore, you must not use the platform if you do not agree to the terms and conditions of this contract. Omandoob reserves the right to modify or change these terms and conditions without prior notice, and it is your responsibility as a user of the platform to regularly review the terms and conditions to stay informed of any updates, through the link https://supermandoob.com/terms-and-conditions. We also encourage you to review our privacy policy to learn more about how Omandoob handles the information provided by platform users.

Eligibility for Services: You acknowledge and warrant the following:

  • You have not previously been disabled from using Omandoob services or prevented from using them at any time.
  • You are not a competitor of Omandoob and do not offer any product competing with the services provided by Omandoob.
  • You have full authority and capacity to enter into this contract and doing so will not violate any law or contract, and there are no legal precedents, arrest warrants, or claims against you with any security authorities.

Commitments and Warranties: You acknowledge and warrant that you will:

  • Comply with all applicable laws and regulations in the Sultanate of Oman.
  • Provide accurate and up-to-date information to Omandoob and update it periodically.
  • Review and comply with any notifications sent by Omandoob regarding your use of the services provided by Omandoob Platform.
  • Use the service or platform for lawful purposes only and will not use the services to purchase or receive any illegal materials or for fraudulent purposes.
  • Not use the service or platform to harm, harass, or annoy anyone.
  • Agree to share information between companies within the platform regarding your executed transactions and evaluation of dealings with you.
  • Not disrupt the proper operation of Omandoob Platform.
  • Not attempt to harm the service or platform in any way.
  • Not copy or distribute the platform or other content without written permission from Omandoob.
  • Keep your account password or any access credentials provided to you secure and confidential.
  • Provide us with all evidence proving your identity, at Omandoob's sole discretion. Omandoob reserves the right to refuse to provide the service or use of the platform without providing reasons.

License Scope: Omandoob grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable, and revocable license to access and use our services solely for personal purposes (not for commercial purposes) in accordance with this contract. Therefore, you must:

  • Not make the services available, rent, lease, assign, resell, distribute, or sublicense these services to any third party.
  • Not modify, disassemble, translate, summarize, or create a derivative work based on reverse engineering the design of Omandoob Platform, or otherwise attempt to access the source code or internal design of the services or any text, multimedia content (images, audio, video), data, or other information provided by Omandoob or third-party service providers.
  • Not delete, alter, or otherwise modify any copyright or other legal notices contained in the services.
  • Not intentionally transmit or distribute the services or allow them to be downloaded for purposes other than as specified here.
  • Not share your username/password or other access credentials for Omandoob services with others.

As part of Omandoob's shipping policy, users and couriers are prohibited from purchasing, delivering, sending, or receiving the following categories of materials and products, and you must allow the courier to open any shipment and verify its compliance with the conditions.

Alcohol
Alcoholic beverages, spirits, wine, champagne, beer, and others.

Prohibited Animals and Species
Animal parts, blood or other fluids, illegal plants, prohibited seeds, plants, and any other organic materials (including derivative products) that are at risk of extinction or prohibited from trade by law.

Pornography
Pornographic materials or those that could involve the sexual exploitation of children.

Copyrighted Materials and Applications
Illegal copies of books, music, movies, or any other licensed and protected materials, including copies that infringe intellectual property rights and illegal copies of applications, software, video games, and other licensed and protected materials, such as original applications, bundled software, or products that enable anonymous email messaging.

Counterfeit and Illegal Goods
Counterfeit goods or designs, unsigned celebrity merchandise that usually requires a signature, forged signatures, currencies, stamps, and other items that may be illegal.

Devices and Tools Used for Bypassing Technical Security
Any chips or devices used to bypass technical security on digital devices, including iPhone unlocking tools.

Drugs and Their Equipment
Prohibited substances, drugs, illegal medications, and preparation equipment, including herbal pills like salvia and magic mushrooms, and materials promoting the use of such products. Legal substances such as plants and herbs intended for ingestion, inhalation, or extraction of illegal substances that produce the same effects as drugs or illegal substances, or those claiming health benefits without proof or verification.

Gambling
Lottery tickets, sports betting, online gambling site memberships, and any related content.

Hacking Materials
Instructions, guides, information, and tools that violate the law by enabling hacking or unauthorized access to applications, software, servers, websites, or any other protected property.

Human Organs
Human organs or any body parts, fluids, stem cells, or embryos.

Illegal and Stolen Goods
Materials, products, and information that promote illegal goods or enable illegal acts. Goods that you do not own or do not have the right to sell. Goods produced in violation of intellectual property rights of other parties. Smuggled goods or goods that violate import and export regulations. Cars subject to transport restrictions. Goods registered in public records (such as real estate) that require formal procedures that cannot be completed online. You and the customer are fully responsible for verifying that all goods you sell are legal and authorized.

Illegal Communication Equipment
Devices designed to intercept satellite and cable signals for free, cable signal decoding devices, encryption cards, card programming devices, and other illegal equipment used to modify mobile phones or other communication devices deemed illegal by the regulatory authorities of the country where these goods are sold.

Miracle Drugs
Unproven treatments and drugs, or substances marketed as quick and effective cures for health problems.

Inappropriate Goods
Goods, literary materials, products, or any other materials that:
● Defame or slander any person or group based on race, nationality, religion, gender, or any other factor.
● Defame or slander any person or group protected from defamation under prevailing law (such as protections available to royal families in some regions).
● Incite or encourage violent acts.
● Promote intolerance and hatred.
● Promote affiliation with terrorist groups or any organizations banned by law.
● Promote revisionist theories as defined by law.
● Contravene prevailing moral standards.

Aggressive and Criminal Goods
Scenes, images, and criminal materials, including personal belongings linked to crimes or criminal acts.

Precious Materials
Large-scale sales of rare or precious metals and stones.

Protected Cultural Materials and Handicrafts
Materials covered by the 1970 UNESCO Convention on preventing the illegal import, export, and transfer of ownership of cultural property, or materials prohibited for sale, export, or transfer under law, including handicrafts, cave formations, and materials related to graves protected under federal laws such as the 1988 Cave Resources Protection Act and the Native American Graves Protection Act.

Fireworks and Hazardous Materials
Fireworks and related items that are considered toxic, flammable, or radioactive in the markets where they are sold, such as gunpowder, explosives, gasoline, and propane tanks.

Regulated Goods
Airbags; batteries containing mercury; Freon and similar refrigerants; chemical and industrial solvents; medical procedures; license plates; police badges and law enforcement equipment; lock-picking devices; medical devices; pesticides; fitness equipment and electrical stimulants; recovered materials; inspection and surveillance equipment primarily used for illegal eavesdropping on oral or electronic communications or enabling unauthorized eavesdropping and recording of conversations; and other goods regulated by the government or any other authority.

Traffic Authority Devices
Radar jammers, license plate covers, traffic signal changers, and other related products.

Weapons
Weapons, ammunition, and any related items, including, but not limited to, concealed and hard-to-detect weapons, artistic weapon designs, silencers, ammunition cabinets, light machine guns, and tear gas.

Wholesale of Currencies
Discounted currencies or trading currencies backed by precious metals.

Delivery to School-Aged Children from Grades 1 to 12 or Younger
We reserve the right to refuse service to all children under 18. Additionally, we reserve the right to refuse delivery to any location within or around schools from grades 1 to 12.

Abuse of the Software Platform
We fully reject any abusive language or inappropriate behavior directed at the company and/or the services we provide and/or any of our employees and/or any couriers working with us. If it is determined, at our discretion, that a client has used abusive language toward the company and/or the service and/or employees and/or couriers, it will result in the permanent closure of the client’s account without any refunds. This includes threats of legal action, defamation, or slander.

Taxi Services
Transporting people within the city.

Heavy and Bulky Items
Large items that do not fit in a small car or items weighing more than 40 kilograms.

Luxury and Valuable Items
Items valued at more than 500 Omani Rials.

Violation of Shipping Policy
Omandoob reserves the right to pursue any available remedies for any violation of the shipping policy, including, but not limited to, restricting access to Omandoob’s services and programs.

Intellectual Property Rights
All intellectual property rights for this platform and all materials related to it or that appear on it (including any content provided or uploaded by Omandoob and all content uploaded on the platform by Omandoob) are the property of Omandoob. Omandoob reserves the right to manage these properties as it sees fit. You must not reproduce or allow anyone, for any reason, to use or reproduce the services or any trademarks or other trade names appearing in the services.

Payment
Omandoob reserves the right to impose new fees for using the platform or the service, or both. If Omandoob decides to impose new fees, you will be informed, and you will be allowed to continue the contract or terminate it.
You are required to pay for services and purchases to the service provider in cash or through approved electronic payment methods immediately after the service is provided, with the option to pay during service delivery. You are solely legally responsible for not paying for services and purchases upon receipt.
Omandoob reserves the right to block the customer if the service value is not paid or if purchases are not received from the service provider. The block will not be removed until the outstanding service fees are paid.

Pricing Method: The delivery service price on the platform is determined by bids submitted by the couriers to the customer. The customer has the right to review all offers and accept the suitable one before the service begins. Once the customer accepts the offer, they are committed to paying the delivery fee upon completion, as outlined in the payment section. If the delivery service includes the purchase of items by the courier based on the customer's request, the courier is obligated to issue an invoice for the total amount and attach a payment receipt as proof. The customer must pay the total amount, which includes the item price plus the delivery fee, as outlined in the payment section.

Indemnity: By agreeing to these user terms and using the platform or service, you agree to defend and indemnify Omandoob, its affiliates, licensors, officers, directors, other users, employees, attorneys, and agents from any claims, costs, damages, losses, liabilities, and expenses (including legal fees) arising from or related to:

  • Your violation or breach of any provision of these user terms or any applicable laws or regulations, whether referenced here or not.
  • Your violation of any third-party rights, including service providers regulated by the platform.
  • Your use or misuse of the platform or service.

Legal Responsibility: The information, recommendations, and services provided to you through the website, service, or platform are for general informational purposes only and do not constitute advice. Omandoob will make every effort to maintain the accuracy and currency of the website, platform, and content but does not guarantee that the content is error-free or free of defects, malware, or viruses, nor does it guarantee the accuracy or timeliness of the website or platform. Omandoob is not responsible for any damages resulting from the use (or inability to use) the website or platform, including damages caused by malware or viruses, or for the inaccuracy or incompleteness of the information unless the damage results from intentional misconduct or gross negligence on the part of Omandoob. The quality of services requested using the platform or service is the full responsibility of the service provider (the courier) who ultimately provides the service to you. Omandoob accepts no responsibility for the services provided by the courier or any related acts or omissions. Complaints regarding services should be directed to the courier.

Service Modifications: Omandoob reserves the right, at its sole discretion, to:

  • Change the services or any related materials; and/or
  • Discontinue the publication of its services. If Omandoob decides to discontinue the publication of its services, it may replace them with similar materials at its discretion.

Liability Limits: Omandoob makes no express or implied warranties regarding the services, which are provided "as is." Omandoob expressly disclaims, to the maximum extent permitted by law, all warranties, including but not limited to fitness for a particular purpose, marketability, and the ability to be sold. Omandoob does not guarantee the accuracy, content, or timing of the services or the results users may or may not achieve from using them. Omandoob, its agents, licensors, or affiliates shall not be liable for any direct or indirect damages, penalties, special damages, incidental or consequential damages (including but not limited to loss of profits, business interruption, loss of business information, or other financial losses) resulting from access to or use of (or failure to use) the services or reliance on them. Omandoob will not honor any offers, advertisements, or contests not announced on its official website or social media channels managed by Omandoob. Additionally, Omandoob is not responsible for any fraud committed via unofficial offers, advertisements, or contests carried out in Omandoob's name.

Security: You acknowledge that you are solely responsible for the privacy of the services and for their use by anyone else using your account and/or username or password or other access credentials. You also agree to notify Omandoob if you become aware of any loss, theft, or unauthorized use of any password, username, or IP address, or any other access credentials.

Third-Party Transactions: While using the website, platform, or service, you may encounter links to third-party websites to communicate with third parties, purchase products or services from them, or participate in promotions they offer. These links take you outside the platform or service and are beyond Omandoob's control. When using the website, platform, or service, you may communicate with or purchase goods or services from, or participate in promotions offered by service providers, advertisers, or sponsors displaying their goods or services via a link on the website or platform. These links take you outside the website, platform, or service, and are beyond Omandoob's control. These websites have their own terms and conditions and privacy policies. Omandoob is not responsible for the content or activities of these websites and cannot be held accountable for them. Therefore, you assume all risks associated with visiting or accessing these sites. Contract Duration and Termination: The contract between you and Omandoob is of indefinite duration. You may terminate the contract at any time by permanently deleting the app from your smartphone, thereby disabling your use of the platform and service. You can close your user account at any time. Omandoob may terminate the contract immediately at any time (by disabling your use of the platform and service) if you:

  • Violate or breach any provision of these user terms, or
  • If Omandoob believes you are misusing the platform or service. Omandoob is not obligated to provide prior notice of contract termination.

Invalid Provisions: The invalidity of any provision of these user terms does not affect the validity of the remaining provisions. If any invalid provision exists in these user terms or an unacceptable provision under certain circumstances according to the principles of reasonableness and fairness, it will be replaced between the parties by a provision that is acceptable and aligns with the invalid provision as much as possible, taking into account the content and purpose of these user terms.

Service and User Terms Modifications: Omandoob reserves the right, at its sole discretion, to amend any provision of these user terms or replace them, or to modify, suspend, or discontinue the service or platform (including but not limited to providing any feature, database, or content) at any time by posting a notice on the website or by sending a notice through the service, platform, or email. Omandoob may also impose limitations on certain features or services or restrict access to parts of the service or the entire service without notice or liability.

Notification: Omandoob may send notifications by sending a general notice via the service or platform, or by sending an email to the email address registered in your account information with Omandoob, or by sending a letter by regular mail to the address registered in your account information with Omandoob.

Applicable Law and Dispute Resolution: These user terms are governed by and construed in accordance with the laws and regulations of the Sultanate of Oman. Any dispute or claim arising from or related to these user terms, including any violation, termination, enforcement, interpretation, or validity thereof, or the use of the website, service, or platform, is subject to the laws of Oman and will be resolved accordingly.
